Terms & Conditions

Elina, the application and related services are owned, developed, and maintained by Elina Education Oy, Company ID in the Finnish Trade Register: 3459835-4, with an address at Birger Kaipiaisen katu 4, 00560 Helsinki, Finland. These Terms & Conditions govern the use of the Elina web applications and related services, including the Elina website and any subdomains thereof.

 

Elina Education Oy (hereinafter “Elina”, “us”, “we”, or “our”) administers and offers the Elina website and the Elina web application. By “Services” hereunder, we are referring to the Elina Web Application and the Elina Website. Reference to “Terms” shall mean these Terms & Conditions.

 

These Terms govern your (hereinafter “User” or “you”) and/or your authorized sub-users’ access to and use of our Services. By registering an account with Elina and/or accessing the Services (whether as a registered User or as a guest without registration) from your computer or other hardware (“Device”) and/or clicking “I AGREE” or a similar action, you agree to be bound by these Terms and our Privacy Policy, which together form a legally binding agreement between you and Elina (the “Agreement”).

 

For the purposes of these Terms, the definition of “User” shall include both our business and consumer customers, as applicable. With regards to business customers, the scope also includes their authorized sub-users of the Services. The definition of “User” also includes unregistered visitors to the Elina Website. Sub-users authorized by the User may include employees, sub-contractors, service providers, or teachers authorized by a school or organization to use the Services. Users are responsible for the actions and omissions of any sub-user they have authorized within the Services, as if these were their own.

 

Your right to use the Services is conditioned upon compliance with these Terms, our Privacy Policy, and, where applicable, any service agreement concluded between you and Elina. Please read these Terms and our Privacy Policy carefully before accessing the Services. If you do not agree with any part of this Agreement, you may not access or use the Services.

 

Introduction

The Services provided by Elina are designed to support early childhood education by enabling teachers to plan activities, gather insights at the group level, and support skill development. Beyond activity planning, Elina offers answers and resources for teachers' various daily questions and needs. Elina also promotes teachers' professional development by providing tools and insights that encourage continuous skill-building and growth. The Elina platform supports teachers' work in early education settings.
 

The Services are continuously evolving, and updates or changes may occasionally cause disruptions or temporary service breaks. Where possible, we will notify Users in advance of upcoming service interruptions.

Disclaimer of Warranty and Liability

You expressly agree that the use of the Services is at your own risk. Neither Elina, nor any of its employees, contractors, third-party content providers, or licensors warrant that the use of the Services will be uninterrupted or error-free. No warranty is made as to (i) the results obtained from the use of the Services or (ii) the accuracy, reliability, or content of any information, service, or product provided through the Services.

 

The Services are provided on an “as is” basis, without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose. Elina acts exclusively as the provider of the platform, and Users are liable for the use of the Services and for the content and materials they submit to the Services.

 

This section does not limit any statutory liability that Elina may have in relation to consumer customers or any liability that cannot be restricted or excluded under applicable law.

 

Specific Terms Concerning Elina’s Use on Web Browsers

Elina is available exclusively as a web application and is accessible through supported web browsers such as Google Chrome and Safari. Users should ensure that they are using a supported browser version to ensure the best experience. We are not liable for performance issues caused by using unsupported browsers or network issues outside of our control.

 

Users’ Obligations

Subject to compliance with these Terms and any applicable service agreement, Elina grants you a non-exclusive, non-transferable, and revocable right to use the Services for their intended purpose. No unauthorized use or use contrary to this Agreement is permitted. As a consumer User, your right to use the Services and content is limited to personal, non-commercial purposes.

 

You are responsible for your use of the Services (and that of your authorized sub-users) and for the security of your account and Devices. You agree to safeguard your account credentials and prevent unauthorized use of your account. You are also responsible for all content and information you submit or your authorized sub-users submit to the Services.

 

You must ensure that all software, hardware, and network connections required for the Services are secure and maintained.

Consumer’s Right of Withdrawal

As a consumer customer, by subscribing to the Service, you understand and accept that the Service will be available to you immediately upon subscription, and that the consumer’s right of withdrawal in distance selling does not apply. However, you may cancel the subscription during the free trial period if you have not previously subscribed or used a similar offer.

 

Data Collection and Processing

Elina may collect and process personal data related to your use of the Services, including contact information and payment details. Elina processes personal data in accordance with its Privacy Policy, which is available at https://www.elinaedu.com/privacy-policy.

 

Restrictions on Use

You may not use the Services for purposes other than planning, documenting, and communicating within the education institution. You agree not to engage in any activities that are harmful to the Services or that violate intellectual property rights, including but not limited to:

 

  • Copying, distributing, reproducing, or publicly displaying the Services or their content.

  • Using the Services in a way that overburdens or impairs the Services.

  • Attempting to bypass security measures or reverse-engineer the Services.

  • Engaging in unauthorized commercial activity or mass messaging through the Services.

 

We reserve the right to limit, suspend, or terminate your account if you violate these Terms.

 

Intellectual Property

All intellectual property rights related to the Services, including content, designs, text, graphics, software, and other materials, are the exclusive property of Elina or its licensors. Users are granted a limited, non-exclusive, revocable license to use the Services and content during the term of this Agreement.

 

You may not transfer, resell, or redistribute the Services or the content therein to third parties. All content is licensed, not sold, and Elina retains ownership of all copies.

 

Confidentiality

Both parties may exchange confidential information during the term of this Agreement. Confidential information refers to any non-public information disclosed by either party. Both parties agree to protect this information and use it solely for the purposes of this Agreement.

Indemnification

Users agree to indemnify and hold Elina harmless from any liabilities, damages, or costs arising from breaches of this Agreement, including unauthorized use of the Services or content by the User or their authorized sub-users.

 

Limitation of Liability

Neither Elina nor the User shall be liable for indirect damages or loss of profit resulting from this Agreement. Elina’s total liability under this Agreement is limited to the total amount paid by the User to Elina in the twelve (12) months preceding the claim.

 

This limitation of liability does not apply in cases of intentional misconduct or gross negligence, or where otherwise required by law.

Termination

Elina reserves the right to terminate this Agreement and your account if you violate these Terms or misuse the Services. You may terminate your use of the Services at any time by canceling your account.

 

Governing Law and Jurisdiction

These Terms are governed by the laws of Finland. Any disputes arising from this Agreement between Elina and business customers will be settled by arbitration in Helsinki, Finland. Consumers are entitled to bring disputes to the competent court of their domicile.

 

Technical Data

Technical Data may be collected automatically as you interact with our Services, through automated logging systems or authorized service providers like Mixpanel, Crisp Chat, Google Analytics, and Microsoft Clarity. Although Technical Data is not typically used to identify individuals, it can sometimes be combined with User Data to identify an individual, in which case we treat it as personal data under applicable laws.

 

We may collect the following categories of Technical Data when you visit or interact with the Services:

 

  • Device information, such as your IP address, device and identification numbers, operating system, browser type and version, and language settings.

 

  • Usage information, such as the date and time of your visit, the parts of the Services accessed, session length, and frequency of use.

Transaction Data

Transaction Data refers to information related to subscription purchases made through the Elina platform. Our payment service provider, Stripe Payments Europe, Ltd., handles most payment-related data. We may process the following categories of Transaction Data:

 

  • Billing address

  • Contact information

  • Date, time, and amount of the transaction

  • Order ID

 

Please note that Stripe processes additional payment data independently according to their privacy policy, available at https://stripe.com/en-fi/privacy.

 

Cookies and Analytics Tools

We use cookies and analytics tools like Mixpanel, Crisp Chat, Google Analytics, and Microsoft Clarity to collect and store information about how Users interact with our Services. Cookies help us track visitor usage, remember user preferences, and improve our Services. You can manage your cookie preferences through your browser settings, but some parts of our Services may not function properly if you disable cookies.

 

Purpose and Legal Basis for Processing

We process personal data to:

 

  • Provide Services and Fulfill Contracts: Personal data is processed primarily to deliver the agreed-upon Services to Users and to maintain and develop Elina’s business. We may also use personal data to respond to customer inquiries or resolve complaints.

  • Comply with Legal Obligations: We process personal data to meet our legal obligations, such as complying with bookkeeping requirements and providing information to authorities.

  • Handle Claims and Legal Processes: Personal data may be processed to manage legal claims, prevent fraud, and ensure data security.

  • Communicate and Market Services: We may use personal data to communicate with Users about our Services or to send marketing materials like newsletters.

  • Improve Services: We analyze trends and usage data to enhance the quality of our Services.

Data Sharing and Transfers

We do not share personal data outside Elina’s organization except in the following circumstances:

 

  • For the Purposes of this Privacy Policy: Personal data may be shared with our affiliates or authorized service providers for data storage, marketing, and other purposes. We ensure that all third-party processors handle personal data in compliance with applicable laws.

  • For Legal Reasons: We may disclose personal data if required by law or to protect the interests of Elina, our Users, or the public.

  • With Explicit Consent: Personal data may be shared with third parties when we have the User’s explicit consent.

 

We primarily store personal data within the European Union (EU) or the European Economic Area (EEA). In cases where data is transferred outside these regions, we ensure that adequate safeguards are in place in compliance with GDPR.

 

Data Retention

We retain personal data only as long as necessary for the purposes of providing the Services. Data is generally deleted when the user relationship ends, or when Users no longer use the Services.
